Abstract: “Why are rape cases increasing in India despite stricter laws?” is one of the most debated socio-legal questions in contemporary India. Over the years, the Indian legal system has introduced several stringent provisions, including amendments after the 2012 Delhi gang rape case, fast-track courts, stricter punishments, and enhanced victim protection mechanisms. Despite these reforms, incidents of sexual violence continue to rise, raising concerns about the effectiveness of law enforcement, societal attitudes, and the criminal justice system. Recent incidents also demonstrate that despite stricter legal provisions, women continue to face extreme insecurity in public spaces. A shocking incident reported in May 2026 involved a 30-year-old woman allegedly being gang-raped inside a private sleeper bus in Delhi by the driver and conductor while she was returning home from work. The case once again revived memories of the 2012 Nirbhaya case and sparked nationwide debate over women’s safety and the effectiveness of preventive policing. This article examines the underlying reasons behind the growing number of rape cases in India by analysing legal, social, psychological, and institutional factors. It explores how patriarchal mindsets, gender inequality, victim-blaming culture, lack of sex education, delayed justice, underreporting, misuse of political influence, and inadequate policing contribute to the persistence of such crimes. The article also evaluates whether the increase in reported cases reflects an actual rise in crime or greater awareness and willingness among victims to report offences. Further, the study critically analyses the role of media, social media influence, pornography debates, family structures, and societal silence surrounding sexual crimes. Important judicial pronouncements, statutory provisions under the Indian Penal Code and National Crime Records Bureau data are also discussed to understand the gap between law on paper and law in practice. The article concludes that stricter laws alone cannot eliminate rape unless accompanied by effective implementation, gender-sensitive education, speedy trials, police accountability, social awareness, and a transformation in societal attitudes toward women. A holistic approach combining legal reform with social change is essential to curb sexual violence and ensure justice and safety for women in India.
