Abstract
The Indian Constitution embodies the principles of Sovereignty, Socialism, Secularism, Democracy, and Republic, affirming India's autonomy from external control and monarchy. The term 'Democratic' signifies the authority of the people through universal adult franchise, aiming to safeguard citizens' rights while maintaining order. The Independence Act of 1947 endowed India with sovereign legislative power, and Article 372(1) continued pre-independence laws, allowing their amendment or repeal. This research hypothesizes that the sedition law counters the constitutional right to free speech. Through doctrinal legal research, it critically analyzes the sedition law's constitutional validity, historical evolution, judicial interpretation, and its contemporary relevance within India's democratic framework.
