Abstract

Abstract- According to WHO the proportion of people aged 60 years and above is increasing and will be 2.1 billion by 2050. As per ‘National Policy on Older Persons'1999 'senior citizen' or 'elderly' are persons of age 60 years or above. As per UNPF the number of senior citizens is expected to grow to 173 million by 2026. In ancient Indian societies, oldest members enjoyed respectable position in socio-political religious spheres. There position deteriorated during British regime as result of industrialization and urbanization, which gave big jolt to joint family concept resulting in younger generation preferring nuclear family. Elders face many kinds of problems and abuses such as health, economic, accommodation problem and physical, medical, sexual, emotional and financial abuse. In India we have labyrinth of laws and policies to protect the fundamental rights of elders such as Five years plans, The Constitution of India,1950, Criminal Procedure Code,1973,Muslim personnel laws, Hindu Adoption and Maintenance Act,1956, The Maintenance and Welfare of Parents and Senior Citizens Act 2007 , National Policy on Older Persons,1999 and for Senior Citizens,2011, Senior Citizen Health Insurance Scheme, Rashtriya Vayoshri Yojana ,Annapurna Scheme, Pradhan Mantri Vaya Vandana Yojana ,Rashtriya Swasthya Bima Yojana ,National Pension Scheme ,Provision for Elderly In The Employees Insurance Act, 1948 and so on. Despite activism shown by legislative, administrative and judiciary still there exist issue of upliftment of elderly population in India .The present research work is based on doctrinal research method of study. The secondary data source has been used for the present research work based on a collection of material from secondary as well primary data sources such as government surveys, reporters, Indian and foreign journals, International Conventions, research articles, newsweeklies, newsletters, internet, books newspaper clippings and various cases on the subject etc. The present research paper will try to critically analyse the limitations of existing statutory provisions and procedural implications and will explore legal possibilities of making amendment.
