Abstract
Trade secrets are frequently pivotal for the very survival of the business. It can include strategies, designs, customer database, formulae, programs, and any other information which is nonpublic in nature and needs to be kept a secret. As per a corner decision by the Delhi High Court in 1995, a trade secret is defined as any information with marketable value, which isn't available in the public sphere and the exposure of which would beget significant detriment to the proprietor. Also, the Trade Related Aspects of Intellectual Property Rights (passages) Agreement from the same time defines trade secrets as information which is kept secret, has a marketable value and the proprietor of the information takes reasonable way to keep it secret. Due to the marketable significance of the trade secret for any business, legal protection of similar information is essential.
