Ad hoc arbitration is a popular form of dispute resolution in India, particularly in company-law disputes. It offers a number of advantages over institutional arbitration, including flexibility and cost-effectiveness. However, ad hoc arbitration also faces a number of challenges, such as the lack of a central authority to oversee ad hoc arbitration, the difficulty of enforcing ad hoc arbitration awards, and the lack of awareness of ad hoc arbitration among businesses in India. This paper examines the advantages and disadvantages of ad hoc arbitration in India, with special regard to company law. It also discusses the challenges to ad hoc arbitration in India and suggests ways to overcome these challenges. The paper concludes by arguing that ad hoc arbitration can be a viable and effective dispute resolution mechanism for complex and high-value disputes in India especially in the corporate sectors. However, the Indian government and the arbitral community need to work together to overcome the challenges to ad hoc arbitration and make it a more effective and accessible dispute resolution mechanism for all parties.
