Abstract
The term 'Control' is defined in various statutes of India. But, there has been problems in understanding this provision and applying it. In Shubkam Vetures Private Limited vs SEBI, when the respondent contended that the protective provisions of the agreement results in acquisition of control, the tribunal held the otherwise. The paper aims at decoding the whole agreement and explaining every clause and analyses whether there is acquisition of control or not.
