Abstract: Up until the late 20th century, there was nominal female participation in the Indian judiciary. Since then, there have been 11 female justices in the Supreme Court of India. Presently there are 3 sitting female justices in the Supreme Court along with 85 women justices serving in the 25 high courts of India and a cumulative 15% of the women are practising lawyers. There is no sole rationale for marginalisation of women in the legal profession but there is an intersection of problems, particularly discrimination and patriarchy, which contributes to the low level of participation of women in the legal profession. Apart from the exclusion from the legal system, women as professionals encounter problems such as gender bias, gender insensitivity and gender stereotyping. This paper critically analyses the discrimination against women judges, women lawyers and women trainees on a common base which is ‘Gender’.This paper is based on primary and secondary data creating a nexus between Gender discrimination, Gender Insensitivity and Patriarchy within the institution.
