Abstract: ‘Justice delayed is Justice denied’ is a very common proverb which means if there is delay in grant of justice, it is similar to that of denial. But in the state of Jammu and Kashmir, the situation of women was so vulnerable that even after a delay of six decades in granting justice to them, the daughters of Jammu and Kashmir are quite happy. Since 60 years, the exclusion of daughters from the state of Jammu & Kashmir on marrying a non-permanent resident was going on which was a sheer state sponsored inequality. The Valley centric regional political parties left no stone unturned to degrade and belittle the status of daughters of Jammu & Kashmir by time and again introducing Permanent Resident Disqualification Bill in State Assembly and Council. And recently in 2019, the historic decision of amending Article 370 and abrogating Article 35A, provided the daughters of the state of Jammu & Kashmir with their due share of human and legal rights. But it is very unfortunate that it took long 60 years to do so. Therefore, the present paper is an attempt to analyse the role of state in sponsoring the inequality between daughters and sons of Jammu & Kashmir. The paper will also highlight the politics of exclusion in the state of Jammu and Kashmir.
